Important pricing clarification: ₹5,000, ₹3,000 and ₹9,000 are Worldtel’s professional charges, not government fees. The objection reply and hearing charges apply only if those stages become necessary. The initial filing fee does not guarantee registration or include every possible future proceeding.

What Can You Trademark?

Brand Name / Word Mark

Protect the distinctive name used to identify your business, product or service, subject to legal registrability and earlier rights.

Examples: a business name, product brand or service brand.

Logo / Device Mark

Apply to register a distinctive graphic logo or visual brand representation. Protection depends on the mark as filed and the applicable legal scope.

Label & Brand Artwork

Depending on the circumstances, a distinctive label or combined logo-and-word presentation may be considered for trademark protection.

Goods & Services

Trademark applications are filed in the relevant class or classes under the Nice Classification system, according to the goods or services covered.

A trademark search helps identify potentially conflicting marks, but no search can guarantee registration. Generic, descriptive, deceptive, prohibited or confusingly similar marks may face legal objections.

Complete Trademark Registration Process

From initial brand assessment to the registration certificate, the process follows several stages. Timelines depend on the Registry’s examination, objections, hearings and any third-party opposition.

STEP 01

Brand Details & Consultation

Share the proposed brand name, logo, business activity, applicant details and intended goods or services.

STEP 02

Trademark Search

Search for identical or similar marks and assess possible conflicts before deciding how to proceed.

STEP 03

Select the Correct Class

Identify the relevant goods/services class. Separate classes may be required for different activities.

STEP 04

Choose Applicant Category

Determine whether the applicant is an individual, eligible startup, eligible small enterprise, company, LLP or another entity.

STEP 05

Prepare Documents

Prepare applicant particulars, mark representation, goods/services specification and user evidence or authorisation where required.

STEP 06

File Form TM-A

Submit the application through the official IP India e-filing system and pay the prescribed government fee.

STEP 07

Application Number

After filing, record the application number and track status through the official trademark portal.

STEP 08

Examination by Registry

The Registry examines registrability and may issue an examination report with objections or requirements.

STEP 09

Reply to Objection

If an examination objection is issued, a reasoned reply and supporting documents may be required within the prescribed deadline.

STEP 10

Hearing, If Required

If objections remain unresolved, the Registry may schedule a hearing. Preparation and appearance requirements depend on the case.

STEP 11

Journal Publication

If accepted, the mark is published in the Trade Marks Journal, opening the statutory opposition period.

STEP 12

Registration Certificate

If the application proceeds successfully and no unresolved opposition or other impediment remains, registration may be granted.

This is the general route. The Registry may raise procedural deficiencies, request further information, refuse an application or require additional steps depending on the case.

Documents Required for Trademark Registration

For Individuals / Proprietors

  • Applicant’s full name and address
  • PAN and identity/contact details as required
  • Clear brand name or logo file
  • List of goods or services
  • Claimed first-use date, if already in use
  • Supporting proof of use and user affidavit, where required

For Partnership / LLP / Company

  • Entity name and registered/business address
  • Partnership deed or incorporation/LLP documents, as applicable
  • PAN and authorised signatory particulars
  • Brand name/logo and class details
  • Authorisation or power of attorney, where required
  • Use evidence and supporting declarations, if applicable
Proposed-to-be-used applications: An applicant may in appropriate cases file on a proposed-to-be-used basis. If a prior-use date is claimed, supporting evidence and the prescribed user affidavit may be required. Do not claim a use date that cannot be substantiated.

Understanding Trademark Objections

Absolute Grounds — Section 9

Objections can arise where a mark lacks distinctiveness, describes the goods or services, is customary in trade or falls within another statutory restriction.

Relative Grounds — Section 11

The Registry may identify earlier marks that are identical or similar and could create a likelihood of confusion for related goods or services.

How Worldtel Can Assist

  • Review the examination report and identify the stated objections.
  • Help prepare a response based on the application details and available evidence.
  • Identify supporting material such as use evidence, invoices, packaging or other relevant records where appropriate.
  • Discuss hearing requirements if the Registry schedules a hearing.

Professional charges: Examination objection reply ₹3,000; hearing assistance ₹9,000. The exact scope, documents, representation and any additional work should be agreed in writing before proceeding.

These charges concern examination objections and hearings. A third-party opposition after Journal publication is a separate contested proceeding and is not automatically covered by these packages.

Trademark Journal & Third-Party Opposition

After acceptance, a trademark application is generally published in the Trade Marks Journal. A third party may oppose registration within the prescribed period, generally four months from publication.

If Someone Opposes Your Trademark

  1. A notice of opposition is filed and served under the applicable process.
  2. The applicant must file a counterstatement within the prescribed time—generally two months after receiving the notice.
  3. Evidence may be filed by both parties according to the applicable rules and deadlines.
  4. The matter may proceed to a hearing and a decision by the Registrar.

Note: Opposition matters are distinct from examination objections. Professional fees and government charges for counterstatements, evidence, hearings or other contested work must be quoted separately after reviewing the case.

Official Government Fees

The following are key online filing fees published by IP India. Always verify the current official fee schedule and the applicant’s eligibility before payment.

Trademark Validity & Renewal

10-Year Registration Period

A registered trademark is generally valid for ten years and can be renewed for successive ten-year periods by filing the required renewal application and paying the prescribed fee.

Monitor Your Brand

Keep your ownership details and contact information updated, preserve evidence of genuine use, and monitor potentially conflicting applications or unauthorised use.

Frequently Asked Questions

What is the total cost of trademark registration?

For one mark in one class, the standard initial total based on our ₹5,000 professional fee is ₹9,500 for an individual or eligible Startup/Small Enterprise with the ₹4,500 online government fee, or ₹14,000 for other applicants with the ₹9,000 online government fee. Extra classes, marks or additional services cost extra.

Is trademark registration guaranteed?

No. Filing does not guarantee registration. The application is subject to examination, statutory requirements, possible opposition and the Registrar’s decision.

What is the fee for an objection reply?

Worldtel’s professional charge for an examination objection reply is ₹3,000. Government fees, if any, and additional work outside the agreed scope are separate.

What is the fee for a trademark hearing?

Worldtel’s professional charge for hearing assistance is ₹9,000. The scope of preparation and representation should be confirmed before engagement.

How long does trademark registration take?

There is no guaranteed completion period. The timeline depends on examination, objections, hearing requirements, Journal publication, any opposition and Registry processing.

Can I apply for a brand name and logo?

Yes, separate applications may be considered for a word mark and a logo/device mark. Each mark may attract a separate government fee per class, so the best approach depends on your protection goals and budget.

What if someone opposes my trademark?

Opposition proceedings require a separate legal and procedural response. Contact us promptly because statutory deadlines apply. Opposition-related fees are not included in the standard examination objection and hearing charges shown above.

Can an LLP or company get the reduced government fee?

The reduced fee is available only to applicants who qualify under the official category rules. An LLP or company should not assume it qualifies automatically; eligibility and supporting proof must be verified.
